Unauthorized Detention and Sexual Assault of a Minor


It was traveled to participate in a school sports competition in Kanchanaburi Province, with the mother’s consent. Mr. Thun Phua resided at a hotel in Kanchanaburi Province, and visited the Dancing Hall. Mr. Thun coaxed Ms. Sudsai to return to the hotel, using a scheme to take her by vehicle, falsely claiming she would take her to her lodging. Subsequently, Mr. Thun drove the vehicle to a secluded location and marshland, where Ms. Sudsai panicked and fled into the fish pond, concealing herself. Mr. Thun continued to secretly observe from the bank of the pond for several hours. Ms. Sudsai, believing Mr. Thun had left, emerged from the fish pond and was then apprehended by Mr. Thun, remaining in his custody for approximately two hours, during which he committed acts of sexual assault. Mr. Thun subsequently married Ms. Sudsai, with the husband’s father consenting. Whether Mr. Thun’s actions constitute any offenses must be determined. Specifically, Mr. Thun parked the vehicle in a secluded location, forcibly restraining and removing Ms. Sudsai’s clothing, and Mr. Thun misled Ms. Sudsai, falsely claiming he would take her to her lodging, resulting in her fleeing into the fish pond, enduring hardship and concealment within the pond, and subsequently exiting the pond believing Mr. Thun had departed, remaining in his custody for approximately two hours and committing acts of sexual assault. Mr. Thun’s actions constitute an offense of taking a woman for immoral purposes and coercive acts. Subsequently, the incident occurred whereby Mr. Thun sought the marriage of Ms. Sudsai, and it is determined that Mr. Thun’s actions constitute a violation of the mother’s authority. Mr. Thun’s actions constitute a violation of the removal of a minor under the age of fifteen from their mother for immoral purposes. Mr. Thun’s intention to take Ms. Sudsai for sexual assault and coercive acts, and to restrain and coerce Ms. Sudsai, represents the initial act of such an offense. Therefore, Mr. Thun’s actions of taking a woman for immoral purposes and coercive acts constitute multiple offenses under the law. Mr. Thun’s intention to take Ms. Sudsai for immoral purposes constitutes the completion of taking a woman for immoral purposes, commencing from the time Mr. Thun began to sexually assault and coerce Ms. Sudsai. Mr. Thun’s act of sexually assaulting and coercing Ms. Sudsai constitutes a separate offense. Mr. Thun’s actions of taking Ms. Sudsai for immoral purposes, coercive acts, and depriving Ms. Sudsai of her freedom, sexual assault, and removal from her mother, all occurred simultaneously. However, the taking of Ms. Sudsai for coercive acts and deprivation of her freedom and sexual assault of Ms. Sudsai constitutes a crime against Ms. Sudsai, the victim, while the removal of Ms. Sudsai from her mother constitutes a crime against Ms. Sudsai’s mother. It is determined that Mr. Thun intended to cause multiple offenses separately, thus, Mr. Thun’s marriage to Ms. Sudsai, displayed openly. This is not a justifiable reason, except for the offense. At the time of the incident, Mr. Thun was already married, and Ms. Sudsai was taken for sexual assault, constituting taking a woman for immoral purposes under Section 284, Paragraph 1 of the Criminal Code. The following offenses are involved: Mr. Thun’s actions constitute offenses of taking a woman for immoral purposes, coercive acts, sexual assault of a minor under the age of fifteen, and the removal of a minor under the age of fifteen from their mother for immoral purposes, as stipulated in the Penal Code Sections 277, Paragraph 1, 317, 310, and 9. A request for advancement to Level 6 is being made.
