Theft of Property and Receiving Stolen Goods Charges


Article 5. Facts as ascertained from the investigation of the case concerning the residence located in Tambon Chanasongkhram, March 2526, at approximately 23:00 hours, Mr. Ka watched television and then went to sleep. Approximately 2:00 AM, Mr. Ka startled awake due to a commotion in the lower ground floor, in Amphoe Phrachon, and roused his son, Mr. Kaew, the eldest son, to investigate. Upon descending to the lower floor and turning on the lights, they found the front door of the house ajar with signs of forced lock-picking. Examination of the property revealed a television set, valued at 3,000 baht, was missing. It was believed that the perpetrator had broken into the house by force. The following morning, at approximately time, Mr. Ka reported the incident to the Police Station Nong Khai 09.0d at Chanasongkhram, located adjacent to his house. In the afternoon of the same day, at approximately 16:00 hours, at Tambon Pom Prap, Amphoe Chao Phraya, the police officers conducted a search of Mr. Kaew’s house in Pom Prap, Prachinburi Province. They discovered the missing television set and delivered the evidence to the Police Station. The investigating officer charged Mr. Kaew with receiving stolen property, alleging that he had received stolen property from a criminal, pursuant to Section 335 and 35 of the Criminal Code. The officer filed a complaint against Mr. Kaew based on the opinion of the investigating officer, as stipulated in Section 158 (5) of the Criminal Code, as derived from the investigation, it was revealed that the deceased, Mr. Thawatchai, was a hired driver operating in Amphoe Mueang Lopburi, and was transported to his destination on March 17, 2525, at approximately 22:00 hours. He did not return, and was not found until 11:41 AM. The Water Management Officials discovered the deceased’s body floating in the Chonlasot Canal facing Wat Sapan, Tambon Ban, Amphoe Ban Mo, Prachinburi Province. The deceased’s body was subsequently found floating in the area of Amphoe Tha Rua, Prachinburi Province, and was subjected to an autopsy as follows: The investigating officer of Amphoe Tha Rua, Prachinburi Province, was responsible for the case, and conducted investigations. The investigating officer of Amphoe Ban Mo, Prachinburi Province, and the investigating officer of the Tha Rua Police Station, Prachinburi Province, were responsible for the case, as stipulated in Section 19 (1), 19 subsection, of the Criminal Procedure Code.
Mr. Kaew is accused of issuing a check for the amount of 20,000 baht per month.
