Provincial Prosecutor’s Representative Duties and Interim Appointment Issues


Order 8. It was found that the prosecution’s claim regarding compensation was not properly determined, thus resulting in a cancellation of the compensation claim of the Provincial Prosecutor. The Prosecutor’s Office 9, Songkhla, and a judgment affecting Mr. One, as follows: valid with 9 laws or not. The order of the Songkhla Provincial Prosecutor is valid because, as the principal representative, the Songkhla Provincial Prosecutor cannot perform official duties due to the absence of the Provincial Prosecutor, therefore, it was appropriate to appoint Mr. One as an interim prosecutor to represent him as stipulated in the Prosecutor Act B.E. 2498 Section 1 Paragraph 1. The order of the Deputy Prosecutor’s Office is incorrect because the order of the Songkhla Provincial Prosecutor 9, as stated above, can be changed by the Prosecutor or the Prime Minister alone as stipulated in the Prosecutor Act B.E. 2498 Section 44 Paragraph 2.
