Property Intrusion, Withdrawal of Claim, and Prosecution Considerations


Exhibit 7. The facts as elicited from the investigative record reveal that Mr. Daeng conducted an intrusion into the property of Mr. Dam. As a result, Mr. Dam reported the matter to Mr. Kao. When Mr. Kao intervened, Mr. Daeng retreated. Mr. Dam then informed Mr. Kao that if he ceased the intrusion, he would not pursue the matter. Subsequently, two months later, Mr. Daeng again intruded into Mr. Dam’s paddy field, and Mr. Dam reported the matter. Mr. Kao, the village elder, and the Prosecutor considered the case file. The Prosecutor then filed the following charges: If, as the court, would pronounce, on January 1st, 1979, Mr. Dam’s statement that he would not pursue the matter if he ceased the intrusion, did not mean to withdraw his claim. The complaint is temporarily suspended. Therefore, the court should continue to consider and adjudicate the case according to the nature of the proceedings (Grand Council) 2016/2500.
