Prohibition of Duplicate Lawsuits Over Identical Legal Claims


The Claim Amount Subsequently, the Prosecutor served as the Plaintiff in a lawsuit against Mr. Jeem concerning the same cause of action. Mr. Jeem requested to be joined as a co-Plaintiff under the condition that if the Court finds the claim amount to be valid in the case he originally filed against Mr. Jeem 25, and if the court order states that the claim amount is valid, then he would withdraw his original lawsuit. This was to ensure that only the case he requested to be joined remained, namely the death of his son, as the Plaintiff with the Prosecutor as the Plaintiff. The Court examined the Prosecutor’s statement and did not object. If the Court were to issue an order, it would state: “No multiple lawsuits are permitted.” According to, Civil Procedure Act, Section 1, it is not permissible for the same person to sue the same defendant in the same cause of action twice.
