Premeditated Assault Resulting in Severe Bodily Injury and Death


Mr. Por engaged Mr. Tong, a known troublemaker, to intimidate Mr. Yo, intending only to cause injury and prevent death. However, Mr. Tong misunderstood and instructed Mr. Yak, Mr. Yo’s subordinate, to ambush and kill Mr. Yo, stating that Mr. Por had hired him to kill Mr. Yo. Mr. Yak subsequently learned that Mr. Por had only requested an intimidation of Mr. Yo, not a murder. Consequently, when Mr. Yo passed by Mr. Yak, he struck him with kicks and punches, resulting in a fractured skull. Mr. Yo required treatment at the hospital as follows: Mr. Por, Mr. Tong, and Mr. Yak will be held liable and sentenced to imprisonment. Mr. Yak ambushed and assaulted Mr. Yo by kicking and punching him until Mr. Yo sustained a fractured skull and required a three-month hospitalization, a grievous injury premeditated beforehand, pursuant to the Penal Code, Section , Paragraph two. Mr. Por hired Mr. Tong to intimidate Mr. Yo, even though Mr. Tong acted himself, but by utilizing Mr. Yak further, it is established that Mr. Por’s actions resulted from the hiring of Mr. Tong, thereby making Mr. Por a principal actor. Mr. Por is therefore liable for causing grievous bodily harm to Mr. Yo premeditated beforehand, pursuant to the Penal Code, Section , Paragraph two. Mr. Tong ordered Mr. Yak to ambush and kill Mr. Yo, constituting the offense of murder premeditated beforehand, pursuant to the Penal Code, Section 289, 84. The penalty is one-third of the sentence, and similarly to Mr. Yak, he assaulted Mr. Yo until he sustained a grievous injury premeditated beforehand, pursuant to the Penal Code, Section 298, 84 Paragraph two. Mr. Tong’s actions fall within the scope of Mr. Yak’s command, therefore Mr. Tong is liable for the offense committed by Mr. Yak, namely causing grievous bodily harm to Mr. Yo premeditated beforehand, pursuant to the Penal Code, Section 298, 84 Paragraph two. The actions of Mr. Tong constitute a violation of multiple legal provisions, and the applicable law will be the most severe, pursuant to the Penal Code, Section 90 (6 points).
