Joint Receipt Allegation and Witness Designation


Order 6. The Prosecutor charged Mr. Sakdi and Mr. Sitti, alleging joint receipt of confession as charged. Mr. Sitti testified in denial. The Court ordered the Prosecutor to separate the case, treating it as a new case and sentencing Mr. Sakdi. The Prosecutor, having already filed charges, subsequently designated Mr. Sakdi as a witness for the plaintiff. Mr. Sakdi stated that if he were a judge, he would decide how to adjudicate the case. The Prosecutor was permitted to designate Mr. Sakdi as a witness for the plaintiff pursuant to Section 232 of the Criminal Procedure Code, prohibiting the plaintiff from citing the defendant in that case as a witness for the plaintiff alone. Although Mr. Sakdi had previously been charged jointly with Mr. Sitti in a prior case, Mr. Sakdi did not appear as a defendant in this case, as he had been separately charged.
