Death Resulting from Assault – Prosecution and Further Inquiry


Mr. Sing apprehending Mr. Sue, caused injury to him resulting in Mr. Sue receiving harm and being admitted to the hospital for treatment. The investigating officer charged Mr. Sing with offenses against Mr. Sue resulting in harm and investigated witnesses and evidence until completed and submitted the investigative report to the Office of the Public Prosecutor. During the investigation, the investigating officer issued a letter to the Office of the Public Prosecutor regarding Mr. Sue’s condition, stating that he was suffering from the effects of the injuries sustained due to the assault. If the Public Prosecutor deems it appropriate to prosecute, he may prosecute Mr. Sing for causing death of another person without intent to kill, or take other action. This case, Mr. Sue died subsequently to the submission of the investigative report to the Office of the Public Prosecutor. The investigative report will be accepted for consideration and a case order can be issued pursuant to the Criminal Procedure Code. The Office of the Public Prosecutor then indicted Mr. Sing on the charge of causing injury to another person resulting in death without intent to kill, under Section 140. The Office of the Public Prosecutor should order the investigating officer to add the charge of causing death without intent to kill and conduct further investigation to ascertain the facts regarding the circumstances of the injury.
