Binding Interest Orders Regarding Labor Dispute Compensation Claims


Order 6. Compensation shall be binding on the defendant to pay compensation to the plaintiff, together with interest as per law, the date of filing, until full payment is made. The defendant must pay compensation to the plaintiff who was dismissed. The Labor Court considered and found that without prior demand, the defendant must pay interest according to the Civil and Commercial Code, Section 22. It is correct or not, the Labor Court ordered the defendant to pay interest retroactively from the date of dismissal. This is a decision exceeding the request, as it did not raise any justification to be considered in accordance with the establishment of the Labor Court, B.E. 2522, Section 52, which is unlawful under Section . (Court of Appeal Judgment No. , Civil Procedure Law, Section 142, Paragraph 1, 2524-2525/2524). The Prosecutor received an acquittal of an organization of state owned by an employee who filed a lawsuit.
