Fraudulent Misrepresentation of Hotel Ownership Inducing Financial Loss
Title: Fraud by False Representation of Hotel Ownership

Mr. In falsely represented to Mr. Chan that he was the owner of “Lanna Thai Hotel” in Chiang Mai and intended to purchase hotel bedding. Relying on such representation, Mr. Chan negotiated and drafted a sale agreement for signature.
Mr. In repeatedly postponed execution of the contract, requesting revisions and further meetings. During this period, Mr. Chan paid approximately 3,000 Baht for meals and goods at Mr. In’s request. Subsequently, Mr. Chan discovered that no such hotel existed in Chiang Mai.
On these facts, Mr. In’s conduct constitutes fraud under Section 341 of the Thai Penal Code. He dishonestly deceived Mr. Chan by falsely claiming ownership of a non-existent hotel, thereby inducing Mr. Chan to expend money for his benefit. The essential elements-false representation, intent to deceive, and resulting property damage-are satisfied.
Accordingly, Mr. In is criminally liable for fraud, and Mr. Chan may also pursue civil damages arising from the wrongful act.
