Payment Dispute: Court Jurisdiction and Potential Claims
Mr. Neung issued a cashier s check to Siam Limited Bank, Branch Ratchaburi, for Mr. Song to use in paying for toy cars. Mr. Song resides in Ban Pong District, Ratchaburi Province, and was to present the check to Mr. Sam in Chaiy Province. The check was for the cost of the toy cars. Subsequently, upon the check s due date, Mr. Sam presented the check to Siam Limited Bank, Branch Ratchaburi, but the bank refused to pay it. Mr. Sam intends to file a lawsuit against Mr. Neung and Mr. Song to recover the funds. The issuance of the debt payment check occurred within the jurisdiction of Ratchaburi Province. Siam Limited Bank, Branch Ratchaburi, rejected Mr. Neung s claim. This rejection occurred at either the Ratchaburi Court or the Nakhon Pathom Court, which is the court of jurisdiction under the Civil Procedure Code, Section 4 (1) and (4). The presentation of the check for the toy cars occurred within the jurisdiction of Chaiy Province. Siam Limited Bank, Branch Ratchaburi, permitted a lawsuit to be filed against Mr. Song at the Chaiy Court or the Nakhon Pathom Court, as this is the court of jurisdiction for a claim arising from that location. Mr. Sam may file a lawsuit against Mr. Neung and Mr. Song at the Nakhon Pathom Court, the Ratchaburi Court, or the Chaiy Court. Any of these courts are under the Civil Procedure Code, Section 5 (2).
