Prosecutor’s Responsibility for Establishing Reasonable Doubt in Investigations


Article 9. The Prosecutor should be aware of the investigative methods employed, as during trial they must have a clear understanding of how to establish guilt beyond reasonable doubt. The primary reason for the power to investigate is to enable them to demonstrate the proof of guilt without reasonable doubt. If the Prosecutor is unable to independently gather evidence or conduct an investigation, they should rely solely on the police investigation, which is merely hearsay evidence and cannot resolve issues that arise during the police investigation. Within the international system, the Prosecutor will rigorously and carefully scrutinize the police investigation, and the international system respects the rights of the accused by releasing him at the earliest stage, otherwise they will make the person suffer from being restrained or detained in custody and further the proceedings.
