Effect of a Final Criminal Court Acquittal on Subsequent Conviction Arising from the Same Incident

In this case, Ms. Ladda filed a complaint alleging that Mr. Green, Mr. Yellow, and Mr. Purple jointly assaulted her. The matter was initially reported to the inquiry officer at Phayathai Metropolitan Police Station. While the public prosecutor was considering the case, Ms. Ladda, believing the process was delayed, independently filed a criminal action against all three defendants for joint assault.

Subsequently, the public prosecutor issued a non-prosecution order. However, Ms. Ladda later filed a separate case against Mr. Green alone before the Criminal Court. The Criminal Court ruled that the incident constituted a mutual affray and dismissed the case. The judgment became final.

Five days later, the Phra Nakhon Nuea District Court convicted Mr. Green, Mr. Yellow, and Mr. Purple, sentencing each to three months’ imprisonment and a fine.

The defendants are entitled to appeal the District Court’s judgment. The proper ground of appeal is that the District Court should have dismissed the case because there was already a final judgment of the Criminal Court concerning the same facts and the same alleged wrongful conduct. Once the Criminal Court determined that the incident was a mutual affray and dismissed the case, such finding affected the entire nature of the dispute and extended to all alleged participants.

This principle is supported by Supreme Court Decision No. 1605-1616/2512, which holds that a final judgment on the same act and factual basis precludes inconsistent subsequent convictions arising from the same occurrence.
