Shortly after, Mr. Beem Phob waved to the passing route bus to stop and received passengers aboard, fully occupied. Consequently, the bus did not stop for Mr. Beem, who became enraged. He then drew a firearm and fired at the bus, one shot. The passenger inside was startled and jumped out of the vehicle, striking his head and dying. This constitutes what offense, Mr. Beem, by firing at the route bus carrying passengers, clearly aimed at the vehicle.
The answer is that the bullet may have struck a person in the vehicle, resulting in death. The fact that one passenger jumped out of the vehicle in fear and struck his head is an act of self-preservation that was not justifiable. Mr. Beem is not liable for the death of the passenger. Mr. Beem is liable for attempted murder, pursuant to Section 288, 80.
