Prosecutor’s Dismissal of Civil Claim Following Judicial Review


Exhibit 2. The Prosecutor is the plaintiff in prosecuting Mr. [NAME UNCLEAR], Mr. [NAME UNCLEAR] (the injured party) filed a petition to be a co-plaintiff with the Prosecutor. The Court granted Mr. [NAME UNCLEAR] to consider the Prosecutor’s complaint and found it lacking in elements and facts, therefore filed a petition to amend and add the defendant. The Court issued no order but instead ruled to dismiss the case. The Plaintiff, the Prosecutor, appealed. Mr. [NAME UNCLEAR] did not appeal but filed a new complaint as Exhibit C. The Court considered Exhibit C and the Prosecutor’s amended complaint, acting as the definitive response. The Court ordered the acceptance of the Prosecutor’s appeal and refused to accept Mr. [NAME UNCLEAR]'s new complaint because it was a double filing pursuant to Section 173(2)(1) of the Civil Procedure Code. The deceased, Mr. [NAME UNCLEAR], was married to Ms. [NAME UNCLEAR], aged 17 years.
