Inheritance Dispute Involving a Minor Heir
Mr. Tsi, acting as the legal guardian and representative of Son , exchanged a land title registered in Son s name for a land title registered in the name of Mr. Si, and they entered into an agreement to register the transfer of ownership and transfer the land to Mr. Si. One month prior to the registration of the transfer of ownership, Son , aged 6 and the sole heir, claimed the land as inheritance and registered the change of name on the land title to his own name. Son refused to register the transfer of ownership to Mr. Si. Mr. Tsi, as the party who executed the agreement and received the inheritance, requested the court to enforce his rights. Mr. Si acted as the legal representative of the direct parties, Mr. Si, and therefore filed a lawsuit to compel Mr. Si to perform the agreement. The agreement was not binding on Son as it had not received approval from the court. According to the Thai Civil and Commercial Code, Section (relating to inheritance), Mr. Si, as a mere heir, was not bound by it. The court will order the dismissal of the plaintiff s claim, Case No. 1546 (1) pursuant to Revision No. 1617/2494.
